Fat Tuesday Giveaway

THIS IS A PROMOTIONAL SWEEPSTAKES. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Please read these Sweepstakes Rules carefully. If you do not agree to the Rules, do not enter the Sweepstakes. The Sweepstakes is void where prohibited or restricted by applicable law, and all applicable federal, state and local laws and regulations apply. Winners are responsible for any taxes, duties and like amounts connected with the Prize.

SWEEPSTAKES:
190 Octane Retail LLC (the “Company”), located at 201 St. Charles Ave., Ste 3600, New Orleans, LA 70170, is the sponsor of the sweepstakes. The Company may be contacted by email to marketing@fat-tuesday.com, or by US mail to the above-referenced address.

SWEEPSTAKES ENTRY PERIOD:
Sweepstakes entries may be submitted after 9:00 AM Eastern Standard Time (E.S.T.) on May 1st, 2025, and prior to May 15th, 2025 (the “Entry Period”). No entries into the Sweepstakes will be accepted prior to the commencement of or after the conclusion of the Entry Period.

ELIGIBILITY:
To be eligible to enter the Sweepstakes, you must (a) be at least 21 years of age or older and (b) be a legal resident of one the fifty United States, excluding Alaska, Hawaii and Rhode Island. One entry per person. Employees, officers, directors – or members of the immediately family or household of the Company or any of their parents, subsidiaries, affiliates, or advertising or promotion agencies involved in this Sweepstakes are not eligible to enter or win.

Alternatively, a participant may enter the Sweepstakes, at no cost or consideration, by hand-printing their name, address, city, state, ZIP or postal code, email address, and daytime and evening telephone numbers (including area code) on standard 8.5” x 11” paper, and mailing such information, in a #10 envelope with sufficient postage affixed, to: 190 Octane Retail LLC, 201 St. Charles Ave., Ste 3600, New Orleans, LA 70170, Attn: Sweepstakes. A mail-in entry will count as one (1) entry into the Sweepstakes. Mail-in entries must be postmarked by May 15th, 2025, and received by May 20th, 2025 in order to be eligible. A participant who enters using this method consents to receive communications from Sponsors for the purpose of administering this Sweepstakes, but will not receive communications from Sponsors for the purpose of providing other offers and communications which may be of interest to the participant.

PERSONAL INFORMATION COLLECTED IN CONNECTION WITH THIS CONTEST IS GOVERNED BY THE COMPANY’S PRIVACY POLICY.

WINNER SELECTION AND NOTIFICATION:
There will be only one (1) prize winner, who will be randomly selected from the valid entries received. The selection will occur on or about May 21st, 2025. The potential winner will be contacted through social media direct message. The potential winner must be able to provide supporting documentation concerning eligibility upon request. If the potential prize winner does not respond to the prize notification within forty-eight (48) hours, is found to be ineligible, fails to execute any affidavit or other documentation required by the Company and/or the prize notification is returned as undeliverable, the Company may consider such prize winner to have forfeited the prize, and another prize winner may be selected as time allows. Subject to the Company’s Privacy Policy, addresses, information regarding the winner may be obtained without charge by sending a written request to the email address or mailing address set forth above in the “Sweepstakes” section.

THE PRIZE:
The prize (“Prize”) consists of the following: (i) two (2) round trip coach tickets from a to be determined major airport nearest to the winner to Las Vegas, Nevada, (ii) one double occupancy hotel room stay for two (2) nights at a to be determined resort hotel in Las Vegas, Nevada; (iii) $300 Visa Gift Card; (vi) $200 Fat Tuesday Gift Card; (v) Fat Tuesday Merchandise Bundle; (vi) 818 Tequila Merchandise Bundle. There will be only one (1) winner. Odds of winning depend on the number of eligible entries received. Winner and Winner’s guest must be age 21 or older, and Winner and Winner’s guest will be required to sign a Liability/Publicity Release prior to ticketing. All dates are subject to change. No responsibility is assumed for cancellation of any events beyond the Company’s control. The estimated retail value of the Prize is $2,400.

WINNER'S VERIFICATION:
The potential Winner must prove eligibility, including, without limitation, proof of age and residence within forty-eight (48) hours of being notified as a potential Winner. In the event of non-compliance by a potential Winner such potential Winner shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternate potential Winner may be chosen from among all of the remaining applicable eligible entries received in Company’s sole discretion. The Winner (and Winner’s guest) must sign within forty-eight (48) hours of receipt of such documents from Company: (a) an affidavit of eligibility and release of Company and its subsidiaries, affiliates, partners, owners, managers, officers, employees, directors, agents, and all others directly associated with the development and execution of this Sweepstakes (collectively, the “Releasees”), from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Sweepstakes or the use/misuse or acceptance of any Prize (as herein defined) or any portion thereof to be eligible for the Prize; and (b) except where prohibited by law, a promotional release granting Company the right to use his/her name, voice and likeness for advertising and publicity purposes without additional compensation; and (c) any other documentation reasonably required by Company, including a W9 form and Winner’s social security number for tax purposes (collectively, the “Releases”). Entry into this Sweepstakes constitutes Winner’s agreement to sign such Releases. Each Winner and Winner’s guest also must acknowledge that Company has not and will not obtain or provide insurance of any kind relating to the Prize and that Winner will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Prize. Winner and Winner’s guest must also complete any additional legal documents provided by Company (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the time frame specified by Company or Winner may forfeit the Prize at Company’s sole discretion. Failure to return all such documents and comply with deadline, noncompliance with these Official Rules or the return of any prize or prize notification will result in disqualification and selection of an alternate Winner. All decisions of Company relating to the Sweepstakes are final. Company expressly reserves the right to delay the announcement of the Winner for creative or technical reasons or for any other reason Company deems necessary.

GENERAL CONDITIONS:
By entering this Sweepstakes, you accept and agree to all terms, conditions and notices contained in these Sweepstakes Rules. Participation in the Sweepstakes is voluntary. All taxes, upgrades and any other expenses not specifically identified in these Official Rules as included in the Prize are the responsibility of the Winner. The Prize that may be awarded to the eligible Winner is not transferable, or exchangeable for any other prize, except as provided herein, or in the Company’s sole discretion. Prize is date specific and the Winner must be available on the dates specified. Any provided tickets are subject to certain terms and conditions specified thereon. Winners are solely responsible for any taxes on their respective prizes. ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED. This Sweepstakes shall be governed by, and construed in accordance with, the laws of the state of Louisiana, regardless of conflicts of laws principles. Any action or litigation concerning this Sweepstakes shall take place exclusively in the federal or state courts sitting in New Orleans, Louisiana, and each contestant/participant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each contestant/participant agrees to service of process by mail or other method acceptable under the laws of the State of Louisiana.

LIMITATIONS AND RELEASE OF LIABILITY:
The Company is not responsible for late, lost or misdirected email, Instagram (or other social media) comments or messages, or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, the Company may cancel, terminate, modify or suspend the Sweepstakes. By participating and entering the Sweepstakes, you hereby release the Releasees, from any and against any and all injury, loss, or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt use, and/or misuse of the prize(s), and you agree that these entities and persons are in no way responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of any prize(s). Additionally, you completely release from any liability related to the Sweepstakes any third parties such as Instagram (on which the Sweepstakes may be promoted) or other social media, and/or 818 Tequila, and acknowledge that such third-parties are in no way sponsoring, endorsing, administering, or associated with the Sweepstakes. By entering the Sweepstakes, you further agree that(i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, any Prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event shall include attorney’s fees; and (iii) REGISTERED PARTICIPANTS HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
